Terms and Conditions
1. Netmarble Rewards Program.
1.1. Rewards Program, Terms. Netmarble Rewards Program (“Program”) offers our customers the opportunity to earn reward points (“Points”) and redeem them towards future purchases of our game products and services at our Program-participating stores (“Participating Stores”). These Terms and Conditions (“Program Terms”) are between you and Netmarble Corporation (“we,” “us” or “Netmarble”) and govern all aspects of your participation in the Program. These Program Terms form part of the Terms of Service.
By using the Program, you agree to be bound by the Program Terms.
1.2. Participating Stores. As used herein, the term “Participating Stores” means our webstores and PC client applications of select Program-participating games, at which you can make qualifying purchases directly from Netmarble.
1.3. Eligibility. The Program is available to any individual player who: (i) is an active Netmarble Account (described below) holder and (ii) is located in the geographic regions where we make the Program available (“Eligible Areas”). We may hereafter add, remove or otherwise update the Eligible Areas from time to time in our sole discretion.
To earn and redeem Points, you must register and maintain an active “Netmarble Aaccount”. Only Netmarble accounts created using your email address are eligible to earn and redeem Points.
Your Netmarble account is governed by the Terms of Service.
If you live in the Eligible Areas, you will be automatically enrolled in the Program when you create an Netmarble Account, and you will start earning Points as you make qualifying purchases. You may cancel your participation in the Program by closing your Netmarble Account or ceasing all Program-related activities.
This Program, including Points and any other benefits provided hereunder, is intended for your personal and non-commercial use only.
1.4. Changes to Program and Terms. We reserve the right to change, suspend, cancel or discontinue the Program or any part thereof at any time in our sole discretion and without prior notice.
Any changes to these Program Terms other than our right to make changes to the Program will be made in the same manner as in Section 18 of the Terms of Service.
2. Earning Points.
2.1. Qualifying Purchases. For each eligible purchase, points equal to a percentage of the purchase price will be credited to your Netmarble Account. As used herein, a “qualifying purchase” means purchase of our in-game products or service items that are designated as Points-eligible (“Eligible Items”) directly from Participating Stores using your Netmarble Account. For the avoidance of doubt, purchases of our game products or service items from a third-party store or platform (such as Google, Apple, Nintendo, Epic or Steam) are not such qualifying purchases. In addition, purchases (or the portion of a purchase) made with redemption of your Points are excluded and thus are not considered a qualifying purchase.
2.2. Points. The number of Points awardable for each qualifying purchase is determined at our sole discretion, and it may vary based on items purchased or your chosen payment method. The number of Points to be awarded and their expiration date will be displayed before your purchase is placed. Points will be credited to your Netmarble Account fourteen (14) days after your qualifying purchase.
2.3. Expiration. Any unused Points will expire in 30 days after they are credited to your account unless we specify otherwise in writing. You can check the balance of your accumulated Points and their expiration dates by logging into your Netmarble Account and selecting “Check My Points” at the Customer Center page.
2.4. Other Promotional Offer. We may also, at our sole discretion, distribute Points for free or offer additional ways to earn them. Accrual and use of such promotional Points may be subject to additional terms and conditions announced at the time of such offer.
3. Using Points.
3.1. Using Points at Participating Stores. Points earned can be redeemed for eligible purchases at Participating Stores. Additionally, the number of points earned may vary by game, and points can only be redeemed at the Participating Store for the game for which the points were earned, unless otherwise noted.
Accounts of Points earned and used will be managed separately for each Program-participating game that you play.
You can use your Points for all or just a portion of an eligible purchase. You are not obligated to use your accrued Points, and they may be used at your discretion. If you redeem your Points to cover a portion of a purchase, the uncovered remaining balance can be paid with another allowed payment method (such as debit or credit cards), provided that the balance amount to be paid is not less than the minimum transaction amount set for the selected payment method and currency. The minimum transaction amount, if any applicable, will be displayed during checkout.
3.2. Deduction of Points. If Points are used at checkout, the Points with the earliest expiration date will be deducted first.
3.3. Final Sale, No Refund. All purchases made by redemption of Points are final and cannot be cancelled or returned for a refund of Points except as required by law. Any refund of Points, if allowed, will be credited back to your account for use within their original expiration date. We may, but have no obligation to, extend the expiration date of refunded Points even if they have expired at the time of refund. Any extension, if given, will be provided at our sole discretion.
3.4. Limits and Other Conditions. Some in-game product or service items sold at Participating Stores may not be available for purchase with Points. There may be additional terms and conditions on redemption of Points as provided in the relevant redemption offers.
4. Restrictions, Other Terms.
4.1. Points cannot be transferred, traded or exchanged, and they have no value outside of the Program and have no cash value. Points are provided on a promotional basis, and you cannot purchase them. Points are and remain the property of Netmarble at all times. We may limit the quantity of Points that may be earned or redeemed.
4.2. If you terminate your Netmarble account in accordance with the Terms of Service or if we suspend or terminate your eligibility to participate in the Program, you will immediately forfeit all of your accumulated Points. The forfeited Points will not be restored even if you recreate your Account.
4.3. At any time and in our sole discretion, we may correct the amount of Points credited to your account. In addition, we have the right, in our sole discretion, prevent, cancel, or reconcile any Points provided to you, terminate your account, and/or disqualify you from future participation in the Program, if you breach these Program Terms or if we believe that you have cheated, We reserve the right to disqualify you from future participation in the Program or to restrict the use of your Netmarble account.
5. Taxes
Points and other benefits provided under this Program may be subject to income or other taxes. You are solely responsible for all federal, state and local taxes and any other costs that may arise or become due as a result of your receipt or use of Points. Any tax liability, including any tax filing obligation, connected with the receipt or use of Points is your sole responsibility. Netmarble will not be liable for any tax liability, duty or other charges in connection with the issuance of Points or any other benefits.
6. Privacy
The information we receive or collect about you in connection with your participation in the Program will be handled according to our Privacy Policy. Please review our Privacy Policy to learn more about our privacy practices.
7. Disclaimer, Limitation of Liability, Indemnification
The Company provides all services "as is" in operating the Program in accordance with Article 9 of the Terms of Service, and does not guarantee the completeness of any internal or external technical errors (including, but not limited to, errors in the network, programs, etc.) that may occur in the process of providing services. All results of participation in and use of the Program are the result of the user's judgment, and the Company does not assume any responsibility and warranty.
8. General Terms
8.1. Your participation in the Program and your access and use of Points and any other benefits are also subject to our Terms of Service and Privacy Policy. These Program Terms incorporate by reference our Terms of Service, Privacy Policy and all other applicable terms, conditions, limitations and requirements. By participating in this Program, you also accept and agree to be bound and abide by all of the aforementioned terms and provisions.
8.2. This Program and the Program Terms are void where and to the extent prohibited by law. If any provision of these Program Terms is found invalid, void, or for any reason unenforceable, that provision is severable and does not affect the validity and enforceability of any remaining provisions
