We created this (this “Guide”) to answer frequently asked questions from creators who produce contents with Netmarble games and to facilitate such content production.
This Guide only applies to the intellectual property that Netmarble holds or manages the rights thereto. In the event a separate policy exists for the Netmarble game, such policy shall take precedence over this guide.
In addition, this Guide only applies to regions where Netmarble games are officially published. Therefore, for particular regions where the games are not officially published, this guide may not apply to the use of the in-game images within such region.
1. Guide to Using Netmarble Game Images
What is a Netmarble game image?
A "Netmarble game image" means a play video or still screen (such as a screenshot) of a Netmarble game.
What is the permitted use of a Netmarble game image?
Creators may use Netmarble game images for the introduction, review, and promotion of Netmarble games to the extent that they comply with this Guide.
However, please note that if you use a Netmarble game image for any purpose other than the above, separate consent is required from the right holders related to the Netmarble game image.
In addition, Netmarble's game image should not be used for purposes other than creative purposes (for example, it should not be used for the purpose of advertising or publicizing one’s or a third party’s goods or services).
Can I make a profit from a Netmarble game image?
Netmarble game images should be used for non-profit purposes only.
Creators can utilize Netmarble game images to create and use content solely for personal and non-commercial purposes, forms and methods, and should not claim fees or compensation from other people or organizations as consideration for accessing the content or transferring the rights thereto.
However, as an exception, if advertising revenue, donation, or subscription fees are received by posting contents on an online platform that provides advertising revenue, donation, or subscription fees through posting videos or still screens (including YouTube, Twitch, Instagram, TikTok, SOOP, Facebook, hereinafter "online platforms"), this will not be considered profitable use.
Examples of using Netmarble game images on an online platform are as follows:
- Uploading Netmarble gameplay videos produced by the creator on online platforms or streaming them on online platforms
- Posting Netmarble game still screens or content using Netmarble game still screens on online platforms
Please clearly indicate the contents are not official contents of Netmarble.
If the creator is not an official partner of, nor in a partnership or sponsorship with, Netmarble, please do not mislead others to believing there is such relationship when using Netmarble's game images.
By taking precautionary measures, such as including the following statement, please do not mislead others to believe that the contents that use Netmarble's game images were officially produced by Netmarble.
'This content is not the official material of Netmarble and contains trademarks or works for which Netmarble holds the rights to.'
Please respect the valuable IP of Netmarble's games so they are not damaged.
You should not illegally modify, remake, or falsify Netmarble's games or Netmarble's game images.
In addition, you should not infringe upon any rights of Netmarble, Netmarble’s affiliates and their respective employees, and Netmarble games, including their reputation, brand image, right of publicity and privacy.
Other matters to comply with when using Netmarble game images:
Netmarble aims to build a wholesome environment for creators and their contents. Please do not create content that is inappropriate, offensive, damaging, or defamatory not only to Netmarble but also to other users.
Please comply with the following.
- You must comply with the relevant laws and regulations of each country.
- You should not acquire or publicize in an abnormal manner Netmarble games that have not yet been publicized.
- The contents should not be used for political or religious purposes or expression of hatred.
- The contents should not include substance contrary to public order and customs or be used for such purpose.
- The contents should not unfairly harm the legitimate interests of Netmarble.
2. Netmarble’s Rights
For postings using Netmarble game images that violate the relevant laws or do not follow this Guide, Netmarble may take certain measures, such as request the deletion of such postings. In addition, Netmarble may be granted legitimate rights from intellectual property holders other than Netmarble and exercise the rights on their behalf.
If this Guide is amended, Netmarble can take measures, such as requesting deletion of the contents using Netmarble's game images, based on the amended Guide.
Netmarble can use contents that utilize Netmarble's game images on Netmarble's official website, Channel Netmarble, official YouTube account, and official Facebook account for the purpose of promoting Netmarble's games. If you do not want us to do this, please feel free to ask us to stop doing so.
3. Other Precautions
Netmarble does not guarantee or indemnify the creators through this Guide, nor is responsible for any problems caused by the their failure to comply with this Guide.
Netmarble does not bear any responsibility for disputes between creators and third parties.
This Guide does not apply to any of our other intellectual property rights.
This Guide may be updated from time to time. Creators should make sure to review the latest version of this Guide before using Netmarble’s game images. Netmarble is not responsible for any problems caused by the creators’ failure to review the latest version of this Guide.
